Amid eurozone turmoil, Germany borrows money for free

The zero-interest sale reflects investors' interest in "a return of their money over a return on their money,"?Rabobank rate strategist Richard McGuire told Reuters.

High interest rates are exacerbating the economic problems in southern Europe. Greece, now in its fifth year of recession, seems more and more likely to leave the eurozone. Even after negotiating a far-reaching debt reduction with private investors earlier this year, the country won?t be able to service the remaining debt. Reuters quoted two Eurogroup officials today confirming that member states are being asked to prepare individual contingency plans for the eventuality of a Greek exit.?

While Germany made its record-breaking bond sale, EU leaders prepared for yet another crisis summit. Tonight they are convening for an informal meeting in Brussels to discuss measures to stimulate economic growth in the eurozone. The meeting is seen as the first battle between German Chancellor Angela Merkel, who strictly objects to growth programs financed through additional borrowing, and the new French president, Francois Hollande, unofficial spokesman for the growing group of leaders who advocate credit-based stimulus plans.

Before the meeting, Germany?s deputy finance minister, Thomas Steffen, rejected renewed calls for the introduction of eurobonds ? debt securities issued by the eurozone as a whole which in effect would mean that Greece could borrow at the same rate as Germany.

?We would sign up for 100 percent liability for new debt in the euro area,? Steffen said in Berlin today. ?We can?t do this, we?re not strong enough economically.?

Explore every option

The easiest way to avoid a debt relief scam? Don?t use a debt settlement or consolidation service. If you can get out of debt yourself?which likely means it?s not an exorbitant amount of money?then do so. You don?t need a third party.

Do your research

Once you decide to go with a debt relief service, get busy learning everything you can about the business. The National Business Reporting Bureau, Yelp and the Better Business Bureau should provide you with some insight on the business? reputation. Keep in mind that even a well-established company might toss something in your agreement that could further hurt your finances.

Jason ?Mayhem? Miller retires from fighting at UFC 146 loss and dismissal from UFC

Jason "Mayhem" Miller is a man of his word.

The now-unemployed fighter said before his bout with C.B. Dollaway that if he'd lost, he'd retire. He dropped a decision at UFC 146 on Saturday, then was cut from the UFC.

On Monday's "MMA Hour," he said he's walking away from fighting after winning 23 bouts and losing nine.

"Every fighter gives the same answer when they say they're retired. Pretty much every fighter says 'I'm retired until I need money.' I'm a pretty smart dude, I have other avenues open to me."

Miller hosts MTV's "Bully Beatdown," and is, as he puts it, a smart dude. He gets business and selling his own brand, which is why he uses the flamboyant entrances that Dana White blasted.

He also shed light on the "backstage incident" White referred to when discussing Miller's dismissal at the UFC 146 post-fight press conference.

"It was my mask," Miller said. "Burt suddenly started yelling about my mask. I had a gas mask for the troops underneath my paper bag, and Burt started telling me right as I'm walking out for the fight. I'm trying to get focused instead of arguing about a paper bag. Maybe it was my fault for, I don't know, I thought we had an understanding once I start walking out to the cage that now I'm working, but obviously we're not on a playing field of mutual respect."

He is referring to UFC backstage director and jack of all trades Burt Watson. UFC events being the well-run events they are has much to do with Watson and the respect fighters afford him. If there is just one rule that supersedes every other in the UFC, it's listen to Burt. Fighters, employees, media and anyone doing business with the UFC knows this. Whether Miller is right or wrong is not important.

Now, Miller will have both the time and freedom to figure out his next move. He tweeted on Tuesday:

Don't worry. I'm not dead. Just analyzing it all so I can share my human experience with you.

Though his next move won't be in a cage, it will still be interesting to see what Miller does with his post-fighting life

One way for you to generate a good income is to start selling space on your website to individuals. While you may think that this is a complete walk in the park, heed my warning; it can be a little complicated. If you are looking for the easiest way to accomplish this I would look to join a banner ad network. When you join a banner ad network they will recruit people that want to advertise, they will keep track of your earnings and control the placement of the ads on your site. Since you are providing the site but someone else is doing most of the work, you end up losing tons of revenue. Since there are many, many more sites that want to offer space on their sites to advertisers than people actually wanting to advertise; which makes banner networks be very selective on what sites they want to work with. Many of your banner ad networks have set in place a minimum amount of traffic the site must obtain. You may be wondering how much traffic is required, it?s a lot. Are you ready? Many banner ad networks require the sites they work with to have at least 300,000 visitors a month to even be considered for a CPM program. A great thing though about some banner ad networks is that they do cater to a wide variety of websites. They can do this by offering different tiers based on monthly traffic. This is a great opportunity for even the small advertisers to also play because it allows them to choose a site and a budget that fits their needs. While banner ad networks do cater to tons of many different sites and advertisers, they do have rules about not showing mature content or any type of offensive material or if you start coming across like you are spamming. If you have a pretty mature site and your site obtains a great deal of traffic than 150,000 impressions per month you should have no problem joining a banner ad network CPM program. If you are just starting out with a new site or still haven?t reached the 150,000 impressions a month, you should look into a click through program. You may not make a lot of money this way because you only make money when someone clicks on your ad. In today?s world less than 5% of people click on ad, but add 5% to the many other ways you drive traffic and it could be good. How Much Could You Expect Once you have joined, banner ad networks operate pretty easily. The banner ad network provides you with a piece of HTML code that you insert on your site. Banner ad networks have been doing this for quite a while so after looking at your site they have a pretty good idea on what type of relevant ads will work. If you own a website that offers race car parts, they would not want to put dog bone ads on it. Like all of us, we are all in business to make a profit; trying to sell dog bones with car parts will not become profitable. Just as a heads up though, since you are in the network you may have very competitive ads against your primary business. Just be mentally prepared for this because you won?t be able to do much about it. Now for the money part, many networks sell what they call ?run of site? ads to advertiser. In doing this they are obtaining around 5 to 6 CPM for most of the ads. Remember what I said earlier on in this article, the network takes a big portion of the revenues ranging from 40-60%. In calculating this for you, my math comes out to be.035 cents per impression that shows on your site. If you generate 100,000 impressions a month you could expect to receive in the ball park of $350. Not bad for allowing a 125 X 125 ad to be placed on your site. So if you allow four ads to be placed on your site you could obtain $1,400 a month. This sounds great, unless these ads really start affecting your other business. Now comparing the same ad but on a CPC rate, you could receive anywhere from 5 cents to 25 cents. If you get a click rate of 5% on the high side, you could maybe clear $100. Sell Your Own Website Space If giving up control of so many things when you turn to a banner ad network scares you, there is another option. You could sell your own site space to advertisers but there are a few things you want to think about. With so many more sites wanting to sell space than advertisers to buy space, it does become challenging. The number one thing that advertisers consider is the layout and how captivating the site is. Advertisers are going to do their due diligence by checking out your traffic and the type of content you provide. These two things are what count because the more traffic and valuable content means better click through rates and conversions. Selling ad space to advertisers is really not rocket science, you just need to provide the information they need to make an informed decision. They will be looking for information like traffic, information about your readers, and how your site will compliment their ad. This concludes series IV of ?Become a Banner Ad Expert Starting Today?. Facebook's tempting 'Promote' button for business | SreeTips ...

This is NOT another article complaining -- or gloating -- about the Facebook IPO debacle. Instead it's about the rollout of a simple feature that appears to have a lot of potential for revenue for the company.

It's the new-to-me "Promote" button that has started showing up on SreeTips, my Facebook business page (I hate the term "fan page"; Eliza Cooper -- @ElizaIn140 -- a friend and social media consultant, helps me run the page). I say "new-to-me" because, with 900 million users, features get rolled out at different times to different users.

As I went to post an item on the page, I noticed the Promote button, which you can see in the screenshot above. Turns out it's a way to make sure more of the folks who have hit like on your page see more of your content (there is no such feature for personal profiles on Facebook -- yet).

For a fee, ranging from $5 to $20, I could expose my post to thousands of more readers and that's very tempting (I presume the cost goes up exponentially for bigger audiences).??

In order to tempt page administrators to pay for more readers, Facebook displays (only to admins) how many people saw a recent piece of content, right in the feed itself. For example, for a recent post about a comprehensive guide to Twitter, you can see that about 2,100 people saw the content, from a total of 5,745 likes (the percentage is incorrect, since it should be closer to 30 percent, but you get the message: lots more people could have seen your content).

As companies plan their social media budgets and how much to spend on Facebook ads specifically, I think there is a lot of potential for Facebook to make more money by promising businesses, including nonprofits, that, for a fee, more people will be exposed to their content.

This raises an obvious question: If I don't pay for more exposure, will Facebook show less of my content now or down the line? According to Facebook's FAQs about Promote, the answer is NO: "Nothing has changed about how your posts are shared with the people who like your Page." You can find the full explanation here.

While we're discussing Facebook's reach, it's worth looking at the screenshots below that show its true power -- not just the raw number of people who have signed up for your content, but the number of friends they have themselves. As you can see, my 5,000+ likes have more than 2.7 million friends themselves.

All of this applies only to business pages and not personal profiles. Things may have changed somewhat, but you'll find plenty of useful tips there.

I want thank Andrew Woods, the Virginia Journal of International Law, and Opinio Juris for the opportunity to respond to such a rich and provocative Article. I could probably write 600 words on any single section of Andrew?s paper, but for present purposes I?ll confine myself to some big-picture issues.

Reordered somewhat, Andrew?s core argument works like this:

1. The apparently retributive features of international criminal law often interfere with the maximization of various good consequences including conflict prevention, conflict resolution, and reconciliation. In particular, moral condemnation and retributive attitudes interfere with consequentialist reasoning. (Part II.B)

2. In the domestic context, similar contra-consequentialist features might be justified by ?the utility of desert?: departures from lay intuitions of justice (?empirical desert?) seldom deter much crime and may even increase crime by undermining the moral credibility of the law and with it voluntary compliance. (Part I).

3. However, international criminal law cannot effectively harness the power of empirical desert, leaving the contra-consequentialist features undefeated. (Part II.A).

4. Therefore, international criminal courts should deemphasize moral condemnation and depart from empirical desert when this will produce better consequences. For example, courts should consider imposing higher or lower punishments to avoid local backlash; alternative sanctions such as public hearings, naming and shaming, revoking professional licenses, and lustration; paying rebels to disarm; granting amnesties; ordering restitution; economic development; and forward-looking conflict prevention. (Part III).

My sense is that accepting many of Andrew?s proposals would make ?the international criminal regime? (Andrew?s phrase) either no longer a criminal regime or no longer a legal regime. For this reason, his arguments are best understood as arguments against deploying the international criminal regime in the first place and using other means to prevent, resolve, and respond to conflict.

Indeed, states should carefully consider whether to place any particular situation before the international criminal regime. But once they do, they should get what they ask for: a rule-governed legal process that defines crimes, determines responsibility, and imposes punishment. We should not expect judges and prosecutors to depart from legal principles, or operate without legal constraints, to maximize conflict resolution or reconciliation in individual cases.

Why not? Why shouldn?t judges and prosecutors maximize good outcomes with every decision they make?

For one thing, judges and prosecutors may lack the competence to do so. Judges and prosecutors generally are trained in law, not in diplomacy or public policy.

More fundamentally, to justify a legal institution on consequentialist grounds is precisely to forsake case-by-case maximization in favor of a system of rules that, as a whole and over time, produces better consequences than ad hoc individual judgments.

Let me conclude with two overlapping points.

First, it?s important to distinguish between the general justifying aims of the international criminal regime and the distributive principles governing individual liability and sentencing. Even if the international criminal regime would not be justified if it did not prevent future crimes, this does not mean that judges should seek to maximize crime prevention through their verdicts and sentencing decisions if this requires departures from legal principles of individual responsibility and ordinal proportionality. Prosecutors and judges best serve the regime?s justifying aims indirectly, by following rules justified by those aims.

Finally, it?s important to distinguish between the constitutive aims of the international criminal regime and the broader goals of the international system. Conflict prevention, conflict resolution, and reconciliation are very important goals of the international system. International criminal law can contribute to some of these goals some of the time, but always does so indirectly, as a side-effect rather than as a constitutive aim. The constitutive aim of criminal law is to condemn and punish serious wrongdoing. Criminal law has many consequential benefits, which may or may not justify it, but if it gives up its constitutive aim it stops being criminal law at all.

Spanish debt costs spiral as crisis deepens

MADRID (Reuters) - Spanish 10-year borrowing costs neared the 7 percent danger level and Bankia shares hit record lows on Monday after the government, struggling to sort out its finances, proposed putting sovereign debt into the struggling lender.

"There are major doubts over the euro zone and that makes the risk premium for some countries very high. That's why it would be a very good idea to deliver a clear message there's no going back for the euro," Rajoy told a news conference.

"There will not be any (European) rescue for the Spanish banking system."

Speaking before Bankia's parent revealed a 2011 loss of 3.3 billion euros - compared to a modest profit previously declared - Rajoy gave no details of recapitalization plans. But he backed calls for the euro zone bailout fund, which will be in place from July, to be able to lend to banks directly.

Government sources told Reuters Spain may shore up Bankia with sovereign bonds in return for shares in the bank and could use this method to prop up other troubled lenders - moves which would push the country's debts above the 79.8 percent of economic output which had been expected this year.

"This method has been used by Germany and by Ireland in the past, it is perfectly valid," a government source told Reuters.

The source said the ECB had not been specifically informed of the plans to inject state bonds into Bankia, although the government was in close touch with the Frankfurt-based institution. A final decision had not yet been made on which option to take.

Bankia's parent company BFA has asked for 19 billion euros ($23.8 billion) in government help, in addition to 4.5 billion the state has already pumped in to cover possible losses on repossessed property, loans and investments.

Investors increasingly believe weak banks, undermined by the collapse four years ago of a decade-long property boom, coupled with heavily indebted regions, could force Spain to seek an international bailout which the euro zone can barely afford.

LACK OF CONFIDENCE

The premium investors require to hold Spanish government bonds over German counterparts hit a euro-era high at 513 basis points, denoting a lack of confidence in Madrid's efforts to stabilize its finances and ailing banks.

Having dropped to around 4.7 percent earlier this year, helped by the ECB's creation of a glut of three-year money, 10-year borrowing costs are now approaching 6.5 percent and closing in on the 7 percent level widely seen as unsustainable.

Ireland and Portugal were frozen out of capital markets and forced to seek international bailouts soon after their yields topped 7 percent.

"If it goes on for much longer, it just adds to the burden of fiscal consolidation," said Elisabeth Afseth, analyst at Investec in London. "If a large part of that is spent on paying a premium to borrow, it just makes it so much harder."

Spain's trump card is that it has issued well over half the debt it needs to this year, in the first five months.

But that advantage is being eroded.

The government said last week its highly indebted regions faced 36 billion euros of debt refinancing bills this year, way above the previously stated 8 billion. Catalonia said it was running out of options and needed central government help.

A plan to recapitalize Bankia with Spanish government bonds, which the bank could then use as collateral to get cash from the ECB, could add to the government's refinancing problems.

Spain's Treasury insisted it would repay debt maturing without problems.

"We are in a very strong position (to meet debt maturing shortly)," said Ignacio Fernandez Palomero, deputy director of public debt at the Treasury, pointing to redemptions in July and October, when Spain has big amounts due.

Spain's central government and regions need to refinance 117.5 billion euros of debt by the end of the year, while funding a deficit worth 52 billion euros.

It has already shifted more than 55 percent of its debt issuance for the year but about half of the remaining debt maturing in 2012 will have to be repaid in the last three months of the year, making it imperative borrowing costs have been brought down by then.

THUMBS DOWN FROM MARKETS

Bankia parent BFA said it had restated its 2011 results to reflect a 3.3 billion euro loss, rather than an unaudited 41 million euro profit. The change came after BFA was forced to review fully its loan portfolios and capital needs as part of the biggest bailout in Spain's banking history.

Despite the 23.5 billion euros rescue cued up for Bankia, its shares tumbled by more than 13 percent, pressuring some weaker peers. Its drastic hike in provisions to cover potential losses from repossessed property and souring consumer debt has raised the prospects that other banks may need to do the same.

A wider audit of Spain's banking system should reveal by June what capital gap other banks will need to fill.

"The events at Bankia will reinforce the view that the upcoming external review should identify a significant recapitalization need for the Spanish banking system," analysts at Nomura said in a note, putting a recapitalization of the whole sector at between 50 and 60 billion euros, with the main listed banks requiring an additional 16 billion euros.

Nomura said only BBVA , Santander and Sabadell would not need to strengthen their capital, while the government would need to clean up smaller lenders it has already propped up, such as Banco de Valencia , Novacaixagalicia and Catalunya Caixa.

"Given the current economic and political uncertainties facing the euro zone, this could see additional pressure on Spain to consider using external funds for the bank recapitalization," Nomura said. ($1 = 0.7992 euros)

ACTA: European Commission negotiation failures | EDRI

The documents made public today provide an extensive guide to the failures of the European Commission to negotiate effectively on behalf of European citizens and businesses. They also provide an insight into the ways in which the Commission's public relations "spin"; seeks to hide these failures.

1. The Commission claims that the ACTA process was transparent.The documents show this to be false.

From the earliest stages, the Commission made weak and unsuccessful efforts to have a transparent process.[2] Despite support from Switzerland, Australia, New Zealand and Canada, the EU was unable to gain any meaningful concessions. The EU ultimately agreed to work to keep all versions away from the public.

The Commission also shows itself to have been completely out-manoeuvred by the United States. Not alone did it fail to negotiate any meanings concession, it haplessly points[3] out in several of the documents that the agreement on confidentiality that it accepted created a huge advantage for the US. Specifically, it permitted the US to show ACTA documents to "selected stakeholders" under non-disclosure agreements while the EU had no equivalent mechanism, thereby giving a big advantage to the stakeholders selected by the US authorities.

2. Failures of transparency extended to the Council Presidency

In the notes from the Seoul meeting, the Commission reports that the Swedish Presidency of the European Council proposed not giving an oral debriefing to the Member States, with the explicit intention of preventing Italy and the United Kingdom from raising concerns about penal sanctions for online infringements. The notes from the Commission indicate shock at this level of undemocratic behaviour, saying that "Sweden even proposed not having an oral debriefing...to avoid giving IT and UK the chance to raise the matter".[4]

3. The proposal on "three strikes" wa s not universally rejected, as the Commission has claimed

The European Commission initially claimed[5] that no proposal on "three strikes" (disconnection of users on the basis of accusations of infringements) had ever been made in the context of the ACTA discussions. Subsequently, when evidence of this assertion being false became public[6], the European Commission accepted that the proposal had been made but that it had been flatly rejected because "most" of the negotiating partners rejected it. There is no obvious trace of such a rejection in the notes from the meetings - the Commission itself comments that this issue is subject to debate in some Member States.[7] In a second comment it, points not to objections to disconnection but to these disconnections being a precondition for ISP liability protections.[8]

The notes also directly contradict statements by Commissioner De Gucht. In March 2012 [9], he claimed that ACTA "will not subcontract the functions of the police to private internet service providers". The fact that the proposals call for "enforcement by ISPs" is explicitly acknowledged in the notes. The Commission's only reservation was that “such an enforcement policy by ISPs should not lead to a general obligation to monitor the information that they transmit or store.[10]

Instead under ACTA, the ISPs would have to decide (faced with the threat of criminal sanctions if they derive "indirect" economic benefit[11] from infringement and the threat of virtually unlimited damages payments[12]) and under pressure from governments obliged by ACTA to promote privatised policing, they want to voluntarily police the Internet and "voluntarily" monitor information they transmit or store and take sanctions against their customers.

4. The Commission does not believe its own argument that ACTA changes nothing in EU law.

In the US, companies and citizens avail of a copyright exception that allows use of copyrighted material without the explicit permission of the rightsholder, as long as this is considered a "fair use". This permits, for example, the use of copyrighted material for parody, the use of short video clips for illustrative purposes, copying of data by search engines to permit indexing and so on. Private copying by citizens is also a copyright exception.

One of the biggest competitive disadvantages created by the EU's regulatory framework is the fact that the regulation of such exceptions and limitations of copyright is dizzyingly complex. This makes it virtually impossible in Europe to set up a search engine, a video-sharing website or any business that relies on copyright exceptions and limitations. This creates a significant competitive disadvantage for EU businesses compared with those based in the USA.

ACTA contains an extremely broad protection of technologies which would prevent, for example, the copying of a legally obtained file. This clearly makes a nonsense of laws which give users the right to make private copies - it is little use having the right to make a private copy if legally protected technology is installed to stop the copy from being made. The Commission explicitly recognised this danger, arguing in its notes that there is "no apparent possibility to safeguard exceptions to copyright/related rights in case of protection against circumvention".[13] This change in the legal framework was explicitly criticised by Canada, New Zealand and Switzerland because this would be, in the Commission's words, this is "an issue of substantive law and not enforcement".[14] This note shows that the European Commission is fully aware of the fact that it is not telling the truth when it says that ACTA is only about enforcement and not about substantive law.[15]

Unfortunately, however, at least a year before any revision of the 2001 Directive which created Europe's chaotic exceptions and limitations regime, the EU agreed to legal protection of technical protection measures in ACTA removing, in its own words, the "possibility to safeguard" flexibilities provided for in EU law.

Rather pathetically, having described why the legal protection of restrictive (and usually proprietary) technologies will undermine usage rights of legally obtained content, the Commission closes that the EU's position is to support "compatibility and interoperability between devices".[16]

5. The Digital chapter: From US incoherence to European vagueness

The documents provide an interesting insight into the development of the digital chapter. It starts with US proposals for far-reaching requirements and occasionally incomprehensible demands with regard to, for example, liability provisions being contingent on disconnecting end-users accused of infringements and finishing with a text which is open to interpretation in line with the original demands but without being as overtly offensive. The original text was so incomprehensible that the Commission notes proudly that the other negotiation partners asked the EU to try to make them make sense.[17]

For example, the final text of ACTA is clear about the intention to encourage enforcement by Internet providers but it whether this should be a requirement for protection from liability is not addressed. ACTA only specifies that liability protections are possible under ACTA, if the interests of rightsholders are not unduly impacted.

The European Commission's support for "self-regulatory" enforcement of copyright law by Internet providers is in direct contradiction to the Commission's obligations under the 2001 Interinstitutional Agreement between the Commission, Council and Parliament. That legally binding agreement explicitly bans (in Article 17) the Commission from using self-regulatory tools where fundamental rights are at stake.[18]

6. The EU could not even make an impact with its good proposals

The European Commission proposed paying particular attention to health and safety concerns in international cooperation provisions.[19] This shows an awareness of the need (completely ignored in the final ACTA text) to prioritise infringements which endanger human health, rather than treating downloaded music files with the same degree of importance as counterfeit medicines.

The European Commission also proposed measures to protect the environment when counterfeit goods are destroyed, following seizure under ACTA measures. This too was ignored, with a typically vague and meaningless ACTA safeguard[20] that the laws of the country where the destruction takes place must be respected.

7. The comprehensive failure of the Commission negotiators is highlighted time and time again

The European Commission has always avoided addressing the widespread criticisms of the lack of clarity of many of ACTA's provisions. The Commission's notes show us how acutely aware they are of the problem. In Seoul, the Commission negotiators tried to push for improvements of the agreement by asking for clarifications on a number of definitions such as "digital environment" and "online service provider"[21]. In yet another failure to exert enough leverage, these definitions did not find their way into the current text. As we know, the vague definitions are one of the many fatal shortcomings of ACTA.

The comprehensive failure of the European negotiators is concerning for a number of reasons, and begs the question of what kind of influence the EU would have in the unelected ACTA Committee if the Treaty passed and was implemented. It also underlines the fact that this agreement, from beginning to end, was driven by the United States -- the documents were drafted in the image of US copyright law, do not include particular aspects of IP that are considered important to the European economy, such as Geographical Indicators (described as being "of great importance" by Commissioner De Gucht[22]), and even on such seemingly trivial aspects, like defining what is meant by "digital environment" could not be achieved by the European representations. How can Commissioner de Gucht continue to assert that ACTA is good for the European economy if it failed consistently to make any positive gains for itself throughout the entire negotiation process?

[1] The US has no domestic law protecting geographical indications. It steadfastly refused, as the EU's biggest counterpart in ACTA, to offer any protection on this point. The EU started the ACTA process by insisting that GI’s be included and finished by saying that they "cannot" be included. It is unclear whether the Commission believes that its original demand was based on incompetent legal analysis or whether the outcome is based on incompetent negotiation.
